Introduction

Antwerppride.com is de digitale representatie van Antwerp Pride Vzw, met maatschappelijke zetel te Draakplaats 1, 2018 Antwerpen. Deze digitale representatie wordt in deze Verkoop Voorwaarden aangeduid met de term "deze Website" of "Site".

Met het “AP-netwerk” wordt verwezen naar Antwerp Pride Vzw, de daarbij aangesloten organisaties, en de daaraan verbonden entiteiten.

Antwerp Pride Vzw, is de entiteit binnen het AP-netwerk dat deze Website verzorgt en dat hierna aangeduid wordt met de termen "Antwerp Pride", "AP", “wij”, “ons”, of “onze”. Hoewel delen van deze Verkoop Voorwaarden kunnen verwijzen naar andere entiteiten binnen het AP-netwerk, geld deze Verkoop Voorwaarden alleen tussen u en ons en niet tussen u en die andere entiteiten.

Deze verkoopvoorwaarden regelen de aankoop van de producten die wij op deze Site promoten en verkopen, hierna genoemd "Producten" en de verzending van die Producten naar de landen aan wie we leveren. Als u iets op deze Site koopt, vragen wij u deze Verkoopvoorwaarden te accepteren en als u dat doet ontstaat een overeenkomst tussen u en ons, die aan deze Verkoopvoorwaarden onderhevig is. Het is daarom belangrijk dat u deze Verkoopvoorwaarden met aandacht leest alvorens Producten op deze Site te bestellen, hierna benoemd als "Bestelling".

U word geacht de Verkoop Voorwaarden te hebben gelezen en te hebben goedgekeurd alvorens een bestelling op deze site te plaatsen.

Description Products and Prices

We do our best to ensure that information about our Products is accurate and recent. However, we do not guarantee that there may not be errors in the description and/or prices of the Products or that the Products will always be available if you wish to place an Order to purchase them.

Additionally, the colors you see on your screen may depend on your computer system and settings so we cannot guarantee that your computer will display those colors accurately.

​

 

We reserve the right to change the information about the Products displayed on our Site, including prices, description and availability. However, such changes will not affect Orders for which you have already received an Order Receipt email (see below).

Purchase Procedure

Here we describe all the steps required to buy something on our Site (in legal terms, to enter into a purchase agreement).

The concluded agreement will be provided to you at the end of the process and will also be accessible to us in the future but not amendable.

​

 

1. Place an Order

  • To complete a purchase, you must first place an Order of Products. Then this Order must be accepted by us.

  • To place an Order you must be 18 years of age or older. To place an Order, you must select the Products on the Site, select your preferred shipping method, as well as other optional services, if you wish, and finally click on the "Checkout" button. We do not accept Orders placed by any other means than those described above.
     

2. Confirmation receipt of Order

  • If you place the Order through the Site, you will receive an automated email confirming receipt of your Order. The Order Receipt email contains full details of your Order (such as Order Number, information about Products, prices, your shipping address, delivery costs and more). Note that the Order Receipt email is NOT yet an acceptance of your Order.
     

3. Prepayment via ABM (optional).

  • We usually collect payment for an Order after confirming shipment of the products in question (see 4th step below).

  • However, if you prefer to use one of our Alternative Payment Methods (ABM), and select one that involves prepayment, we will collect payment upon confirmation of the Order (see 2nd step above). Please see our payment terms for more details.
     

4. Shipment Confirmation.

  • When your Order has been accepted by us, we will send you an email confirming that all, or part, of the Products have been shipped.

  • Once you have received the Dispatch Confirmation email, your Order has been definitively accepted by us and the purchase agreement between you and us is complete in respect of the Products dispatched at that time. This agreement consists of: your Order; our Order Receipt; our Order Receipt email and Shipping Confirmation email; the then-current Terms of Sale. No other terms and conditions will apply.
     

 

If Orders are not accepted

While we do our best to always accept Orders, in certain cases we may still refuse an Order, for example:


If you provide us with incomplete, inaccurate or fraudulent information about your identity, age, payment information, billing information, shipping address;

If we discover that there was an error on our Site regarding the Products you ordered, for example regarding the price or description displayed;

If the Products you ordered are unfortunately out of stock or no longer available;

If we have reasonable grounds to believe that you intend to resell the Products.


If we cannot accept your Order, we will contact you by email as soon as possible and in any event no later than 30 days from the date of your Order.  If we cannot accept your Order because the Products are no longer available, or there is an error in the price and/or other information on our Site, we will refund you any amount you may have already been charged for those Products.

Exceptionally, if you have selected an ABM, we may have already collected your payment and then discover that the Products may not be available. In that case, we will contact you immediately and provide a full refund.

Delivery conditions

We offer limited delivery options from which you can choose one that best suits your needs and location. Specific terms and conditions may apply to the different delivery options, as well as different delivery costs.

  • Belgium

    • Standard Delivery - €5

    • Pick up from our pop-up store at the city festival hall in Antwerp - Free.

      • This option is only available during Antwerp Pride

  • Benelux ( France / Netherlands / Luxembourg ) 

    • Standard Delivery - €10

  • Europe ( Austria / Finland / Germany / Ireland / Italy / Portugal / Spain / Sweden / U.K. )

      • Parcels < 1 kg - €20

        • Parcels > 1 kg - €35

Track Shipment

You can track the shipment of your products by clicking the "Track your order" link in the shipment confirmation email. Please note that this link will take you directly to the courier's website which is not controlled by us.

Returning conditions

We hope you are very satisfied with your purchase from Antwerp Pride but understand that you may wish to return one or all of the Products. You can return products within 30 days of receipt (right of withdrawal) if you are not satisfied or if you have changed your mind.


This is a right of withdrawal that you can exercise without penalty and without giving any reason.

Please note that as long as the Products remain in your possession, you are responsible for keeping them safe, secure and in good condition.

​

 

We do not recognize a right of withdrawal for Products for which you have asked us for modifications (e.g. with individual colors, materials, monograms) through our personalization function. Personalized products can of course be returned if they are defective.

​

 

In addition, we do not recognize a right of withdrawal for Products that have already been opened or put into use.

​

 

Also, you can return defective Products within the longer period determined by your local legislation (legal warranty for consumer goods).

​

A Product is "defective" if it is received damaged or if a manufacturing or material defect occurs within 2 years (or such longer period, which may be determined by your local law) of purchase. Please note that Products damaged due to wear and tear are not considered defective.

​

 

In either case, you may receive a refund.

If you have encountered problems or wish to make a complaint about a Product, or a purchase you have made through this Site, or if you simply need after-sales support, you can contact us via the 'contact us' link under the topic "Shop" managed by our Promotions Team.

Liability

Our liability for damages caused by slight negligence will be limited regardless of its legal basis as follows: (i) we will be liable up to the amount of foreseeable damages typical of this type of agreement due to breach of material contractual obligations; (ii) we will not be liable for slight negligent breach of any other applicable duty of care.

The above limitations of liability will not apply to any legal liability, a liability for intentionally caused personal injury. In addition, such limitations of liability will not apply if and to the extent that AP has assumed a specific warranty. The above provisions will apply in accordance with our liability for fruitless efforts.

​

 

In any case, you must take appropriate measures to avert and mitigate damages.

 

Please note that we cannot be held responsible for delays or if we fail to perform our duties under these Terms of Sale if such delay or failure is caused by circumstances beyond our reasonable control, including, for example, natural disasters, war or public order disturbances, strikes, government intervention, failure of our supplier(s), failure of you if you have not provided us with the correct information or made the payments due. We will inform you of such contingency as soon as possible after it occurs and we will do our best to reduce its impact on our performance to the extent reasonably possible. Should this interruption last longer than 2 weeks, you will be entitled to cancel the Order and receive a refund.

Nothing in these Terms of Sale shall affect your statutory rights as a consumer, such as the right of withdrawal or the right to a free guarantee period for defective goods, as stated in section "Return Terms" and nothing in these Terms of Sale shall exclude or limit any liability of AP Network that cannot be excluded or limited under applicable law.

Personal data

By placing an Order, you agree that we may store, process and use your personal data for the purposes of processing your Order. We will process your information in accordance with our Privacy Policy.

Use of this Site is also subject to Terms of Use of our Website.

Consumer Rights Litigation

These Terms of Sale are governed in all respects by the laws of the country of delivery applicable to your Order, regardless of any conflict of law rules, including but not limited to, your local laws implementing the Consumer Rights Directive 2011/83/EU.  The competent courts of that same country shall have exclusive jurisdiction in connection with any dispute arising as a result of a purchase made on this Site or a Product, subject to any right under the mandatory provision of applicable law to institute legal proceedings in the consumers' usual place of residence or domicile.
